The Labour Court rejected Eamonn Ryan’s appeal over public holiday pay, finding that Carlow County Council had correctly calculated his pay during the claim period. The determination was dated 29 June 2023. Ryan argued that his regular rostered overtime and an eating-on-site allowance should be included in the calculation. The Council said it had paid him in accordance with the law. The Court found that the regulations excluded overtime from public holiday pay and that the allowance compensated an expense rather than forming part of his pay. The Court found no breach during the claim period. The complaint was not well founded and the appeal failed.
