The Labour Court found it had no jurisdiction to consider Sean Reilly’s claim for public holiday pay against the Minister For Enterprise Trade and Employment. The decision, dated 24 May 2024, varied the Adjudication Officer’s decision. Reilly argued that his work as a Rights Commissioner and Adjudication Officer made him a worker entitled to public holiday pay. The Minister argued that Reilly was no longer working during the relevant limitation period and was not entitled to the payment. The Court found that the contractual arrangement had ended no later than 3 July 2018, before the period covered by the claim. It therefore had no jurisdiction to decide whether Reilly was substantively entitled to public holiday pay; the merits were not decided.
