Labour Court rejects IMPACT equal-pay appeal over Dublin Institute of Technology technician role

By Gráinne Nolan

Labour Court ·

In 2003, the Labour Court dismissed IMPACT’s appeal on behalf of Kay McEvoy, upholding the Equality Officer’s decision that her work was not of equal value to a male technician’s at Dublin Institute of Technology. The determination was signed on 21 January 2003.

After inspecting both jobs, the Court found cooking was an integral part of the technician’s duties and was performed regularly, practically every week during term. He also supervised and directed kitchen staff. The Court found those duties involved greater skill and responsibility than McEvoy’s work, including responsibility for handling and storing raw meat, poultry and fish. It concluded that the two employees were not engaged in like work and disallowed the appeal.
