Labour Court upholds Enterprise Ireland’s place as respondent in equality claim

By Ruairí Dolan

Labour Court ·

The Labour Court upheld the Equality Officer’s decision that Enterprise Ireland was the appropriate respondent in Irene Mc Mahon’s equality claim. The determination was dated 25 June 2007. It decided which organisation should answer the claim, not the underlying discrimination allegations. Enterprise Ireland argued that University College Dublin employed and paid Mc Mahon and handled her redundancy. Mc Mahon said Bio Research Ireland, a division of Enterprise Ireland, had engaged her and set her pay. The Court found that Bio Research Ireland’s manager set Mc Mahon’s salary and that the division was part of Enterprise Ireland. University College Dublin administered wages funded by an Enterprise Ireland grant, acting as paymaster. The Court therefore upheld the decision naming Enterprise Ireland as the respondent.
