Labour Court rejects worker’s disability discrimination appeal

By Ruairí Dolan

Labour Court ·

The Labour Court disallowed a worker’s appeal over alleged disability discrimination in his dismissal and affirmed the Equality Tribunal’s decision. The determination was dated 13 November 2013. The worker said he was dismissed after a workplace injury. The concrete manufacturer said he stopped attending work and it assumed he had resigned. The Court found he had not proved that the accident occurred or that the company knew he had a disability. It also said the medical certificates did not establish the extent of an injury and the doctor who issued them did not give evidence. The Court found the company had acted recklessly in assuming the worker had abandoned his job, but said whether the end of employment was an unfair dismissal was not the issue in the appeal.
