Labour Court reduces Arravasc award to Gerard Cahill to €27,000

By Saoirse Doyle

Labour Court ·

The Labour Court upheld a disability discrimination finding against Arravasc Limited and reduced Gerard Cahill’s compensation from €42,640 to €27,000. The Court disallowed Arravasc’s appeal in a determination dated 1 December 2016.

Cahill was an agency worker at Arravasc’s Galway plant. The company argued that it was a provider of agency work, not Cahill’s employer, and denied discriminating against him. The Court found Arravasc liable as the provider of agency work and said it had substantially and materially contributed to the circumstances that led to the end of Cahill’s employment.

The Court found that Arravasc acted hastily and failed to consider reasonable accommodation after Cahill suffered a heart attack. It found that the company discriminated against him on the disability ground and awarded €27,000 compensation, payable within 42 days.
