Labour Court dismisses workers’ age discrimination and victimisation appeal

By Rory Hanlon

Labour Court ·

The Labour Court dismissed Michael McGrath and John Ryan’s appeal against Athlone Institute of Technology on 14 April 2016, affirming the Adjudication Officer’s decision. The appeal concerned age discrimination in redeployment and grade progression, and victimisation.

The Court declined jurisdiction over the redeployment claims because the workers’ 2012 agreement settled claims arising from the cessation of the Trade Courses and their redeployment. The grade progression claim failed because the workers provided no evidence to disturb the earlier finding that there was no connection with age. Their victimisation claim failed because they did not establish a connection between the alleged adverse treatment and a protected act.
