Labour Court upholds pregnancy discrimination finding but halves Wrights of Howth Seafood Bars Limited award

By Cathal Brosnan

Labour Court ·

The Labour Court upheld a finding that Wrights of Howth Seafood Bar Limited discriminatorily dismissed Dorota Murat because of her pregnancy, but reduced her compensation from €30,000 to €15,000 on the employer’s appeal. The Court dated its determination 26 October 2017.

Murat said she was dismissed because she was pregnant. The employer said performance concerns were the reason. The Court found she received insufficient induction and support, was given no warnings and had no opportunity to respond before her dismissal. It concluded the dismissal was tainted with discrimination and the employer had not proved it was unrelated to her pregnancy.

The Court also found that the employer gave no substantiated written grounds for the dismissal. It said the €15,000 award was compensation for the effects of discrimination, not lost wages, and varied the adjudication officer’s decision accordingly.
