The Labour Court dismissed Kieran O’Toole’s appeal and affirmed the preliminary decision that his three age and gender discrimination claims were out of time. The determination was signed on 27 March 2017; the discrimination merits were not decided. O’Toole argued the alleged discrimination formed a connected chain of events and that other proceedings and internal processes affected the time limit. Brothers of Charity Services Galway argued the claims concerned alleged events from 2009 to 2011 and were filed too late. The Court found no alleged discriminatory act within the relevant six-month period, no discriminatory practice establishing a continuum, and no basis to extend time based on the claimed misrepresentation about physiotherapy.
