The Labour Court dismissed Tim Desmond’s disability discrimination appeal against Rehab Group Trading As Rehabcare, affirming the Adjudication Officer’s decision. The determination was dated 19 November 2019. Desmond cited inconsistent instructions about personal care, a supervisory meeting and a period without work. Rehabcare said the instructions were clarified, supervision was routine and relief work depended on availability. The Court found Desmond had not established facts from which disability discrimination could be inferred.
