The Labour Court upheld the decision rejecting Paul Dusa’s complaints of discrimination and harassment on the family status ground against Excel Recruitment Ltd, in a determination dated 1 August 2023. Mr Dusa said weekend overtime requests disregarded his childcare responsibilities and that he was treated disrespectfully after raising concerns. The company said the requests asking staff about overtime availability went to all agency workers and that weekend work was optional. The Court found Mr Dusa had not been compelled to work overtime and that the requests were sent regardless of family status. It found no evidence that he was treated less favourably because of that status, and said the alleged treatment was not shown to be related to it. Three associated appeals concerning employment information, parental leave and working time were withdrawn.
