The Labour Court has affirmed the dismissal of Siobhan McNally’s complaint against the Rotunda Hospital as frivolous. In a determination signed on 3 April 2025, it said earlier decisions finding other claims out of time left no realistic prospect of this complaint succeeding. McNally argued that her complaint deserved a substantive hearing. The hospital said earlier time-limit findings meant it could not succeed. The appeal concerned the frivolous finding; the Court did not decide the underlying discrimination allegations.
