Labour Court dismisses worker’s discrimination claim for lack of jurisdiction

By Orla Quinn

Labour Court ·

The Labour Court dismissed a worker’s discrimination claim against a retail company after finding it had no jurisdiction to hear the case. The determination was signed on 5 September 2001. The worker alleged discrimination on grounds of sexual orientation and gender, including in a June 2000 appointment process. The company argued that his employment fell outside Irish jurisdiction. Although he spent about 60% of his working time at locations in Ireland during the period examined, his office, administrative work, reporting arrangements and permanent residence were in Northern Ireland. The Court found he had not shown that he habitually carried out his work in Ireland. The allegations were dismissed without a decision on their merits; the merits were not decided.
