The Labour Court found that Customer Perception Limited discriminated against Gemma Leydon by dismissing her after she requested time off for physiotherapy. It ordered the company to pay her €9,500 compensation.
The determination was signed on 12 December 2003. Leydon worked as a business development executive and assessor. After a road traffic accident left her with injuries the Court found amounted to a disability, the company said her field role required a car and she had not replaced hers.
The Court found she could carry out the duties using public transport in the short term. It also found her request for time off influenced the dismissal, and that the company had not shown the lack of a replacement car, rather than her disability, was the reason. Compensation took account of the circumstances and her financial loss.
