Labour Court awards worker €5,000 for dismissal-related victimisation

Labour Court ·

The Labour Court awarded a worker €5,000 after finding that her dismissal amounted to victimisation following her complaint of sexual harassment by her manager. The determination was dated 18 July 2007. The Court found that her dismissal was mainly occasioned by her good-faith opposition to unlawful conduct.

The worker said she was dismissed shortly after making the complaint and receiving a timekeeping warning. The engineering company said it dismissed her for poor timekeeping. The Court noted that no late arrivals or absences were recorded between the written warning and her dismissal, and found the final disciplinary sanction unjustified.

A separate Equality Tribunal decision had awarded her €7,000 for discrimination and €10,000 for victimisation while she remained employed. Neither side appealed that decision. The Labour Court said those awards did not cover the separate claim concerning her dismissal.
