In 1993, the Labour Court dismissed a worker’s complaint against Brookfield Leisure Limited under the Employment Equality Act as not well founded. The order was signed on 16 December 1993. The worker, a lifeguard and fitness instructor, said she was dismissed because of her sexual orientation and that a man would have been treated differently. Brookfield Leisure denied discrimination. The Court found she had been treated arbitrarily and unfairly, without a chance to answer a client’s complaint, but concluded this was not discrimination under the Act. It said a man would probably have received the same treatment for a similar display of sexual orientation.
