Labour Court dismisses out-of-time equality complaints against Bank of Ireland, remits two

By Niamh Kearney

Labour Court ·

The Labour Court dismissed the worker’s older equality complaints against Bank of Ireland, while remitting two in-time complaints for investigation. The determination, signed on 30 April 2015, left unresolved the worker’s complaints about being required to retire at 60 on age and disability grounds and a refusal to return to full-time work on age grounds. The Court found claims about a performance appraisal, an employee loan and a referral to a psychiatrist were out of time. It rejected an extension because the worker’s lack of knowledge of the law did not justify the delay. The equal-pay claim was misconceived because deciding it would require a hypothetical examination of the facts. The Court also found the victimisation complaints misconceived: the union’s earlier letter did not refer to an Equality Act complaint or proceedings.
