Labour Court upholds ruling against Noelle Cunning in fixed-term contract appeal

By Saoirse Doyle

Labour Court ·

The Labour Court upheld the Rights Commissioner’s decision against Noelle Cunning in her appeal over fixed-term contract renewals, finding her complaints not well founded. The determination was dated 7 October 2013. Cunning argued that she had become a permanent employee and was entitled to a contract of indefinite duration. Dublin Institute of Technology said the contracts covered a colleague’s career break and job-sharing hours. The Court found that the colleague had a right to return to full-time work and that using fixed-term contracts to cover his absence and remaining hours was appropriate and proportionate. The Court found the complaint about the September 2009 renewal was brought outside the time limit and was not well founded; the merits were not decided. It found the other complaints not well founded and did not allow the appeal.
