The Labour Court upheld a finding that Stobart (Ireland) Driver Services Ltd did not penalise driver Scott Hazel for a protected act, in a determination signed on 29 March 2017. Hazel said the company penalised him with a final written warning after he refused a run because he believed the hours posed a safety risk. The Court found the potential for driver fatigue was not a serious and imminent danger that could not reasonably have been averted. It also found the working hours required for the run were not legally barred.
