The Labour Court rejected the Services Industrial Professional Technical Union’s claim that Elliott Engineering Limited breached the Construction Industry Registered Employment Agreement by not registering a former worker in its pension scheme. The recommendation was signed on 26 February 2001. The union argued that the worker’s welding, driving and construction-site duties brought him within the agreement. Elliott Engineering said it was a sheet metal manufacturing company outside the agreement. The Court found the company was not covered by the agreement and rejected the union’s claim.
