The Labour Court found that John Patrick Malone, Seamus Martin Malone and Paul James Malone, trading as Prokote Painting, were a building firm covered by the Construction Industry Registered Employment Agreement. Its decision was signed on 4 August 2010. Jakub Nowicki, who worked as a painter on building sites in the greater Dublin area, sought an interpretation of the agreement. He argued that his job was a craft position covered by it; the employers disputed his entitlement to seek an interpretation, citing the delay since his employment ended. The Court found Nowicki was a construction operative entitled to the pay rates and employment conditions specified by the agreement.
