The Labour Court did not recommend the Irish Transport and General Workers Union’s claim to reinstate a worker as a forklift driver in the Irish Sugar Company’s loading bay. The recommendation was signed on 27 September 1988. The worker had refused to use a forklift he considered unsafe and was transferred to a non-driving role while retaining the forklift rate. The union argued he should return to his former position. The company said the vehicle had been checked and found safe, and that the worker was driving another forklift in the same sugar store without loss of pay. The Court said the company had not acted unreasonably and did not recommend conceding the union’s claim.
