In 1989, the Labour Court recommended that the Irish Transport and General Workers’ Union accept Gallaher (Dublin) Limited’s proposal to rotate an employee into a packing department supervisor role for two years. The recommendation was signed on 29 December 1989. The union argued the appointment bypassed an agreement requiring supervisory vacancies to be advertised internally. The company said the move would develop the employee and would not create a vacancy unless the rotation went ahead. The Court considered the company’s policy of developing future management staff from its existing workforce reasonable. It said the rotation would not lessen other workers’ promotion prospects. If the employee was promoted at the end of the period, the resulting vacancy would be opened to competition among other staff.
