In 1990, the Labour Court declined to recommend conceding the Irish Transport and General Workers Union’s claim for reinstatement of a worker dismissed by Quigley Company of Europe Limited. The recommendation was signed on 1 February 1990. The union said the worker, a Volvo driver with long service, was dismissed after refusing an instruction to cover his vehicle’s bucket with canvas in wet weather. It argued the instruction changed established work practices without consultation and that disciplinary procedures were breached. Quigley said the measure was temporary and reasonable, and that the driver continued to refuse after the instruction was explained. After considering both sides’ submissions, the Court did not recommend reinstatement.
