Labour Court clarifies Waterford Crystal redundancy and redeployment terms

By Niamh Kearney

Labour Court ·

In 1993, the Labour Court clarified how Waterford Crystal Limited could contract out non-core services while keeping restrictions on compulsory redundancy. The recommendation was signed on 24 February 1993 and concerned 49 workers at the company’s plants in Kilbarry, Butterstown and Dungarvan. The Court said an earlier recommendation restricted compulsory redundancy to consultation with employees and their union representatives, but did not prevent contracting out. It interpreted Waterford Crystal’s options as securing continued employment in alternative jobs for workers who wished to remain. Workers were to choose one of the options; if a worker seeking to stay did not apply for an alternative position, the company could redeploy that worker. If redeployment reduced their grade or removed a shift premium, the parties should negotiate compensation. Waterford Crystal Limited said its proposals had been accepted by workers before the ballot. The Amalgamated Transport and General Workers Union argued that workers understood the agreement to exclude compulsory redundancy and redeployment.
