The Labour Court recommended that a driver employed by Bus Atha Cliath be given equal opportunity for future overtime and rest-day work at Broadstone, subject to satisfactory performance. The recommendation, signed on 25 February 1994, followed a dispute referred by the National Bus and Rail Union against Bus Eireann. The driver had not been rostered at Broadstone since disciplinary action over irregular payments. The union sought compensation for lost overtime and fair consideration for future work; Bus Eireann said the casual work was discretionary and the alleged duplicate payments called his suitability into question. The Court said the claim for payment for dates when the driver could have worked but was not called must fail. It recommended equal opportunity for future work that arose, provided he performed it satisfactorily.
