The Labour Court recommended against granting a Bus Eireann worker’s transfer request at that time, saying existing agreements with the relevant unions prevented it. The recommendation was signed on 29 November 1996. The worker had applied repeatedly for vacancies in Waterford, saying most went to temporary or unappointed drivers despite a company letter stating he would be considered. Bus Eireann said transfers were governed by the national agreement and the unions had not agreed to its proposal to give established drivers priority over temporary staff.
