The Labour Court found there had been no constructive dismissal when a general manager left The Earl Inn after a dispute over time off. Its recommendation was signed on 16 May 2000.
The worker said the employer refused his request for time off when his son was in hospital and verbally abused him. He said he had been forced to leave and claimed losses of £3,600, excluding a bonus. The Earl Inn denied dismissing or abusing him and said he left voluntarily after rejecting alternatives.
The Court said both sides had worked long hours under severe strain around the club’s reopening, while the worker was also facing family problems. It found that a genuine disagreement had arisen, but there had been no constructive dismissal.
