The Labour Court rejected the Services Industrial Professional Technical Union’s claim to use a consolidated pay rate when calculating sick pay for Tipperary Co-Operative’s clerical members. Its recommendation was signed on 22 March 2002. Both sides accepted that an agreement set the payment method, but the union said it had understood it could raise the issue later. The company maintained that the agreement was clear. The Court accepted that it applied as written.
