The Labour Court did not recommend changing commission terms for future recruits at Roches Stores because of the cost of complying with current legislation. Its recommendation was signed on 16 September 2003. Mandate sought commission for new sales staff on the same basis as existing staff. Roches Stores had proposed ring-fencing commission for current employees and paying new recruits a non-commission rate. The Court recommended that the parties enter negotiations if the company needed to rationalise or restructure.
