The Labour Court recommended that Techniform Waterford Limited pay €7,500 compensation to a quality engineer after finding her dismissal unfair. Its recommendation was signed on 24 October 2003. The worker said she had taken on extra duties and was dismissed while on sick leave. The company said her performance had declined and that she had been absent without correct notice on an audit day. The Court found that the company had not tried to help her address the performance difficulties it perceived, had no disciplinary procedure and failed to follow basic provisions of the statutory code of practice. It also found it particularly unfair that she was required to attend the dismissal meeting while on sick leave.
