Labour Court backs Daret Manufacturing Ltd over worker’s termination claim

By Fionn Kelly

Labour Court ·

In 2003, the Labour Court upheld Daret Manufacturing Ltd’s decision to terminate a worker’s employment and did not recommend conceding the worker’s claim for loss of employment and earnings. The recommendation was signed on 13 November 2003. The worker said he had not been told during his initial probation that his performance was unsatisfactory and felt management had forced him to leave. Daret said it had provided training, counselling and warnings, then extended his probation to give him more time to improve. The Court noted the training and extended probation, found the worker’s account was not substantiated and did not recommend concession of the claim.
