The Labour Court recommended changes to Dublin Kegs Limited’s sick pay scheme after a claim by Mandate on behalf of truck and forklift drivers. The recommendation was signed on 19 January 2005. Mandate said the company changed the scheme in 2002 without consultation and sought continued full pay during illness. Dublin Kegs said its scheme was fair and the claim was precluded under Sustaining Progress. The Court recommended eligibility after six months’ service, with sick pay beginning after three working days and based on full basic pay less social welfare benefit. It recommended a maximum of four weeks’ sick pay for employees with up to five years’ service and eight weeks for those with more than five years. Medical or social welfare certificates would be required for absences exceeding three working days, and future scheme amendments should be agreed jointly.
