In 2005, the Labour Court recommended against further compensation for six cleaners employed by Dunlaoghaire Harbour Company after regular rostered overtime ended. The Services Industrial Professional Technical Union argued that the overtime had been pensionable and that the buy-out agreement did not resolve its separate pension claim. The company disputed the claim. The Court noted that the parties had agreed a buy-out averaging approximately €11,000 for the six cleaners. It found the twice-the-annual-loss formula was within the normal settlement level and saw no basis for further compensation. The recommendation was dated 10 June 2005.
