The Labour Court recommended that a worker at Heatons - Letterkenny accept the company’s offer of up to one weekend shift in five and up to two public holidays a year. The recommendation was signed on 5 December 2005. The worker’s contract allowed the company to roster her on a five-day-in-seven basis, but she said longstanding arrangements had protected her work-life balance. Heatons said it needed flexibility as weekend trading increased. The Court found the custom and practice relied on by the worker’s union could not override the clear contract provision and considered the company’s offer reasonable.
