Labour Court recommends €2,000 settlement for worker’s dismissal and holiday-pay claims

Labour Court ·

The Labour Court recommended that C Jennings (Craughwell) Limited pay a worker €2,000 in full and final settlement of claims concerning alleged unfair dismissal and unpaid holiday pay. The recommendation was signed on 14 June 2006. The worker said the new owner terminated his employment after buying the retail store in Craughwell and was liable for unpaid holiday pay under the transfer rules. The company said no managerial post was available and the previous employer had paid any holiday pay due. The Court noted that the parties agreed the transfer regulations applied and that the current owner was liable for outstanding employment-related sums. With uncertainty over the precise amount and no records available, it recommended €2,000 to settle all outstanding claims. The worker had agreed to be bound by the recommendation.
