The Labour Court recommended that Henry Denny & Sons apply the 2000/2001 redundancy formula of four weeks’ pay per year of service plus statutory entitlements, without a cap. For each worker accepting the company’s offer, it also recommended crediting notional earnings equal to 10 hours’ overtime a week when calculating pay. The Services Industrial Professional Technical Union had sought 12 weeks’ pay per year of service. The company offered four weeks plus statutory entitlements, subject to a cap. The Court said the parties had not sufficiently quantified historic and current overtime levels. The recommendation was signed on 12 April 2007.
