The Labour Court recommended that M & S Machinery Limited give a worker an equitable share of available overtime, withdraw and expunge verbal and written warnings, and provide available training and necessary safety clothing and footwear. The recommendation was signed on 30 October 2008. The worker, a mechanic with more than 14 years at the company, said his overtime had stopped despite work being available. He also challenged warnings and said he had been denied technical training and safety footwear. The company said there was no trade dispute and did not attend the hearing. The Court said the investigation process was procedurally flawed and the warnings unfair, based on the worker’s uncontradicted submissions.
