The Labour Court recommended that Gernord Ltd consult Unite after future reviews of its profit-sharing scheme, provide the union with a full explanation of the scheme in English, and use the criteria applied before 2005 to determine any payments for 2006 and 2007. The recommendation was signed on 27 April 2009. Gernord said the French parent company changed the scheme's methodology and that changes were made at board level. Unite said workers expected annual payments based on past practice and had not been consulted or told of the changes before learning that no payment would be made for 2006.
