The Labour Court recommended that HSE West pay a worker €13,089.59 in compensation for loss of earnings after a transfer of services from Merlin Park Regional Hospital to University College Hospital Galway. The recommendation was signed on 6 May 2009.
The worker, a staff nurse at Merlin Park, said management had told her she would receive the full two-year compensation formula after the transfer, but reduced her payment when she took a permanent post at University College Hospital Galway. HSE West said the formula was for staff who remained at Merlin Park and incurred a loss of premium earnings there.
The full compensation was €17,593.27; the worker received €4,503.68. The Court noted that an August 2007 letter had told her she would receive the full amount, and that she continued to incur some loss in her new role. It recommended that HSE West honour that expectation by paying a further €13,089.59 within four weeks.
