The Labour Court recommended €7,500 compensation for a worker it found had been unfairly dismissed by Knockmuldowney Restaurants Ltd, trading as Markree Castle Hotel. The recommendation was signed on 22 October 2009.
The company said the worker’s attitude had not improved and that her personality did not suit its business. The worker said no concerns had been raised about her performance, attitude or personality and that the company had denied her its disciplinary procedures.
The Court found that the dismissal process did not comply with the Code of Practice on Grievance and Disciplinary Procedures and that management had not told the worker her employment was in jeopardy before ending it. It concluded that the dismissal was both substantively and procedurally unfair and recommended compensation in full and final settlement of the claim.
