Labour Court rejects Eircom Limited worker’s claim for pensionable allowances

By Niamh Kearney

Labour Court ·

The Labour Court rejected a worker’s claim for pensionable allowances and recommended accordingly in a recommendation signed on 19 May 2010. The worker had sought to restore allowances lost after a 1999 reorganisation and to have his pension entitlements revised. The worker had received unsocial-hours allowances for 24 years as a Senior Night Telephonist at Waterford Telephone Exchange. After the exchange closed, he was redeployed and no longer worked unsocial hours. Eircom Limited said the changes followed a collective agreement and that compensation for lost allowances was provided through the Mark Time arrangement. The Court found that the 1999 collective agreement had been freely negotiated with the worker’s representative union and fully implemented. It did not recommend conceding the claim.
