Labour Court recommends Waterford Senior Care reaffirm worker’s status

By Orla Quinn

Labour Court ·

The Labour Court recommended that Waterford Senior Care Limited, trading as Home Instead Senior Care, write to a care worker to reaffirm her employment status and set out available work options. The recommendation was signed on 28 November 2011. The worker said she was removed from a live-in care assignment without notice or reason and argued that this amounted to dismissal. The company disputed that she had been dismissed, saying hours depended on caregiver availability and client needs. The Court found no dismissal and said the removal was for operational reasons under her contract, but considered the handling inappropriate and noted that no alternative work had been offered. Other claims about her conditions of employment as a live-in carer were withdrawn.
