The Labour Court found that a worker’s dismissal by the Catholic Primary School Management Association was unfair and recommended compensation equal to six months’ salary. The Court’s recommendation was signed on 3 October 2013.
The worker said he was dismissed during probation without fair procedures. He said a meeting he considered disciplinary was not identified as such in advance and he was not offered the chance to have a representative. The employer did not attend the hearing.
The Court accepted the worker’s uncontested account, finding that the employer had failed to follow its own disciplinary procedure or the Code of Practice on Grievance and Disciplinary Procedures. It found the dismissal unfair and recommended compensation equal to six months’ salary. The worker had agreed to be bound by the recommendation.
