The Labour Court recommended that HSE West pay a worker an acting allowance retrospectively from 1 April 2010 and said there was merit in regularising her position under HSE HR Circular 017/2013. The recommendation was signed on 28 May 2015. The worker had performed a Grade VII role while paid at Grade IV and sought regularisation and backdated allowance. The Court noted that no appeals process had been introduced and that she remained paid at a lower grade rate. It also said the HSE should use its established dispute procedures for such matters rather than refer them under section 20(1) of the Industrial Relations Act 1969.
