The Labour Court rejected a worker’s claim for €1,662.12 in unpaid overtime and recommended that he accept time off in lieu for 18 occasions. The Court said his travel from Limerick Junction to Inchicore to provide training did not meet the essential operational requirements exception to Irish Rail’s time-off-in-lieu policy. The recommendation was dated 22 September 2015. Irish Rail said its cost-containment agreement provided time off in lieu instead of overtime for executive grades. The worker’s union argued that the programme had not imposed a blanket ban and that some executive staff still received overtime.
