Labour Court recommends Debenhams promote worker and pay €2,000

Labour Court ·

The Labour Court recommended that Debenhams Retail (Ireland) Limited appoint David Morrissey to the next Loss Prevention Officer Supervisor vacancy in one of its stores identified at the hearing, and pay him €2,000 compensation. The recommendation was signed on 5 February 2016.

A Rights Commissioner had recommended that Morrissey be promoted immediately, with lost earnings from November 2013 to August 2015 treated as the appropriate disciplinary sanction. Both Morrissey and Debenhams appealed. He argued the recommended demotion period was too long and sought reinstatement from an earlier date. Debenhams said no position was then available and it would offer the next vacancy.

The Court agreed with the earlier recommendation but adjusted how it would be applied, citing practical difficulties with immediate appointment. If Morrissey was not appointed during 2016, the Court recommended a further €500 per quarter from the first quarter of 2017 until he was appointed.
