The Labour Court set aside an earlier recommendation on a worker’s pension allowances in its decision signed on 13 May 2016. On Brothers of Charity Services South East’s appeal, it recommended assessing the worker’s role for an appropriate Health Sector grade, effective from 1 June 2015. The grade should reflect the full role, with no continuing need for allowances. The earlier recommendation had called for the allowances to be incorporated into basic pay for pension calculations from 1 January 2015. Brothers of Charity Services South East argued that HSE advice and scheme rules meant the allowances could not count towards pensionable pay. The union said they reflected the worker’s core duties and should attract pension rights.
