Labour Court recommends UCD count worker’s compulsory overtime as pensionable salary

Labour Court ·

The Labour Court recommended that University College Dublin recognise a worker’s regular compulsory overtime as pensionable salary. The recommendation, signed on 8 July 2016, followed a dispute over whether his overtime should count toward his pension. The worker said he had worked about six hours of overtime each week for more than 20 years. UCD argued that its pension scheme excluded overtime and that it could not alter the scheme. The Court found that the overtime was compulsory, regular, rostered and part of the worker’s conditions of service, meeting the standard for classification as pensionable salary. It recommended that the claim take effect from November 2014.
