The Labour Court affirmed a recommendation that a worker be allowed access to Western Brand Group’s sick-pay scheme for an absence from 19 May to 10 June 2015. Its decision was signed on 24 February 2017. Western Brand Group argued that the worker had not met the scheme’s reporting requirements. The Court noted uncertainty about the doctor’s role in certification, the scheme’s clear reporting terms and that the illness was not disputed. It recommended that the worker be allowed to access the benefit for that period.
